Privacy policy

§ 1 General provisions

  1. This Privacy Policy (“Privacy Policy”) sets out how Primesoft Polska sp. z o.o. (“PRIMESOFT”) processes data necessary for the provision of the services provided via the primesoft.co.uk website and the V-DESK application. (“PRIMESOFT”).
  2. The administrator of the data is Primesoft Polska sp. z o.o. with its registered office in Poznań (60-650) at ul. Piątkowska 161, entered into the Register of Entrepreneurs of the National Court Register on the basis of the entry made by the District Court Poznań – Nowe Miasto and Wilda in Poznań, VIII Economic Division of the National Court Register, under KRS number: 0000221565 , having NIP number: 7831592998, REGON number: 634610845 (hereinafter referred to as “Administrator”).
  3. A User, within the meaning of the Privacy Policy, is any natural person using the services provided by PRIMESOFT.
  4. The User acknowledges that the provision of data by him/her is voluntary; however, the lack of consent to process such data by PRIMESOFT may result in PRIMESOFT’s inability to provide electronic services to the User.
  5. The purpose of the Privacy Policy is to define the actions taken by PRIMESOFT, regarding the data collected through the website www.primesoft.pl and the V-DESK mobile application.
  6. The Privacy Policy is governed by Polish law, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“RODO”), as well as the Act of 18 July 2002 on the provision of electronic services (i.e. Journal of Laws of 2017, item 1219, as amended).
  7. Capitalized expressions used in the Privacy Policy shall have the meaning given to them in the Terms of Use of the PRIMESOFT service, unless the contrary is clear from the Privacy Policy.

§ 2 Data processing

The data provided by Users, is processed for:

  1. establishment of a User Account and the provision of electronic services by PRIMESOFT, including the provision of support services to the User, management of User Accounts, and resolution of technical problems;
  2. electronic transmission of marketing offers and commercial information by the Administrator;
  3. to make payments using the Application or the Service,
  4. enforcing compliance with the PRIMESOFT Terms of Service.

§ 3 IP address and cookies

  1. PRIMESOFT is authorised to collect data through technologies such as cookies, tracking pixels and objects provided locally (e.g. in your browser or on your Device). Cookies (“cookies”) are small text files that store data locally on your computer, mobile phone or other Device. Pixels are small images that are part of the code of a website, which enable another server to, among other things, measure page views, and are often used together with cookies. The website code tracks if and when (and on which page) a pixel has been loaded, providing information that the User has viewed part or all of a particular page.
  2. By means of cookies, the website server is able to store information, e.g. about the preferences and settings of the User’s computer, mobile phone or other device, which are reproduced on a subsequent visit.

§ 4 Rights and obligations of the Administrator

  1. The Administrator processes Users’ personal data in compliance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (“RODO”), as well as the Act of 18 July 2002 on the provision of electronic services (i.e. Journal of Laws of 2017, item 1219, as amended).
  2. The controller shall ensure that appropriate technical and organisational measures are in place to ensure the security of the personal data being processed, in particular to prevent unauthorised third parties from accessing them or processing them in violation of generally applicable laws, and to prevent personal data from being lost, damaged or destroyed.
  3. The User’s personal data will be stored for as long as necessary for the Administrator to provide the services.
  4. The Administrator has the right to share the User’s personal data with: subsidiary companies; third parties in the event that the Administrator sells all or part of its shares to them, or in the event of a merger between the Administrator and a third party, or the acquisition of shares in the Administrator’s Company by a third party.

§ 5 User rights and obligations

  1. The user who has provided the Administrator with his/her personal data has the right to:

    (a) access to their data and to receive a copy of their data;
    b) rectification (amendment) of his/her data;
    (c) erasure of the data (the so-called right to be forgotten),
    (d) to have the processing of his/her personal data restricted:
    (e) to have your data transferred to another controller;
    (f) to object to the processing of your data, including profiling, and for direct marketing purposes;
    g) to withdraw consent where the Administrator will process the User’s data on the basis of consent, at any time and in any way, without affecting the lawfulness of the processing performed on the basis of consent before its withdrawal;
    h) to lodge a complaint with the President of the Office for the Protection of Personal Data when the User considers that the processing of personal data violates the provisions of the RODO.
  1. The User may request PRIMESOFT to delete or update the personal data provided by sending a request to PRIMESOFT at the following email address: office@primesoft.pl
  2. If the User permanently deletes the personal data necessary for the Administrator to provide the services, the User will lose the possibility to use these services.
  3. The Administrator reserves the right to amend the Privacy Policy in accordance with the rules set out in the PRIMESOFT Terms of Service.

The privacy policy comes into force on 28.11.2016
